The Tutoring Institute (“The Tutoring Institute” or “Company” or “We”) respect your privacy and are committed to protecting it through our compliance with this policy. This policy describes the types of information we may collect from you or that you may provide when you visit the website www.thetutoringinstitute.com (our “Website“).

This Privacy Policy is designed to help you understand how The Tutoring Institute and our affiliates collect, process, store, and share personal information about our Users. It also explains what controls you have on how The Tutoring Institute collects and processes your information. The term “you” or “User” refers to students, parents/guardians, tutors or any person or entity who views, uses, accesses, browses, or submits any information to the Service (defined below).

Providing your personal information is voluntary and your use of the Service constitutes your acceptance of this Privacy Policy. If you do not agree to all the terms and conditions of this Privacy Policy, do not use our Service or Website.

  1. Scope of this Policy

    This Privacy Policy applies only to personal information we collect via the website www.thetutoringinstitute.com (“Platform”), online and any mobile applications (“Apps”) if applicable, email, telephone, electronic devices, and other interactive services (collectively “the Service”).  This policy does not apply to information collected by us offline or through any other means, including on any other website operated by Company or any third party. This policy also does not apply to any Partners or third party, including through any application or content (including advertising) that may link to or be accessible from or on the Website.  You should become familiar with any Partners or third parties Privacy Policy.

  2. The Information We Collect

    1. We may collect information about your browser and device (IP address, browser version, etc.) but we cannot link that information to an identifiable person unless and until you create an account.

    2. If you do choose to use our Services, you must provide us with some personal information so that we can provide the Service. This includes information you provide to us, such as:

      1. registration information when you create a User account
      2. profile information, such as city and state, educational level or background, tutoring subjects, and birthday
      3. uploaded content (profile, photographs, CV/resume, classes, etc.)
      4. lesson recordings (whitespace lessons are recorded on a third-party site, www.thelessonspace.com, but not audio or video)
      5. You are approving to read and follow the lessonspace Privacy Policy and Terms of Service.
      6. questions, comments, or other information when you communicate with us, by phone, email, or via third party social media sites, or participate in interactive features of the Service (such as online tool chat messages);
    3. Customers:  students, parents, guardians

      1. We may also collect personal information when you fill out our questionnaire, to make payments for tutoring sessions, tutoring questions related to homework, school information, teacher’s responses of a student and their progress (only if the student is 18 or older or a parent/guardian has granted us permission), and content you upload for other Users or Public display (such as questions, homework for the Tutor to help you with, online reviews of the Tutors)
    4. Tutors

      1. For tax purposes and to run a background check, we may need to collect: your Social Security number or Federal Employer Identification Number, date of birth, address, and phone number. We may also collect bank account information to make payments via direct deposit. However, currently, we are not collecting your SSN or FEIN or bank account information via the website.
      2. We may also collect information that will be listed on your online profile (such as education, and hobbies) or information sent to Students and Parents/Guardians or information that may be used for marketing purposes on our social media.
    5. Financial information

      1. Our company is hosted on the AWS Server. AWS provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through AWS’s data storage, databases and the general AWS applications. They store your data on secure servers behind a firewall.
      2. All direct payment gateways offered by Stripeand used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
    6. Information we collect automatically

      1. When you use the Service, we collect certain information primarily for security and function of our Services. This information consists of the type of browser you use, access time, pages viewed, IP address, and, if enabled, geolocation; and we collect information about the computer or mobile device you use to access the Service, including without limitation operating system and unique device identifiers and mobile network information. However, this information does not reveal your identity.
      2. The personal information that we collect may include the following: name (students, parents, tutors), phone number, email address, mailing address, job titles, education history, usernames, birthdays (to determine age). This data is used to better understand and enhance Users experience with the Service and on the Platform and Apps. The Tutoring Institute may publish aggregate User statistics or share them with third parties.
    7. Information we collect from other sources

      1. We may also obtain personal information from our background check administrator and combine that with information we collect through the Service. For example, we may view information about you for the purposes of identity verification, credit bureaus, educational background, and other background check information, including from publicly available sources, but this information is not stored on our systems. User generated content on the Platform or App that is cross-posted through certain social networking preferences (e.g. pages you “Like” or “Follow”) may be viewed by the general public. Accordingly, The Tutoring Institute cannot ensure the privacy of any personal information included in such User generated content.
  3. How We Use Your Information

    1. The Tutoring Institute may use your personal information for various purposes, including:
      1. account creation and to provide the Service, including without limitation, access to previous lessons, tutor-matching services, information about prospective tutors, and facilitating communication directly between students and tutors;
      2. to process transactions and billing;
      3. for identification and authentication purposes;
      4. to communicate with you concerning the Service, User requests, transactions, security, privacy and administrative issues relating to your use of the Service, and services that we think may be of interest to you;
      5. improve the Service and deliver and display targeted advertisements on our Service, content or features in the Service and on other sites or apps; and
      6. for administration of and troubleshooting regarding the System
  4. Information We Share and Disclose

    1. We do not sell your personal information. To make the Platform work, we may need to share some of your personal information with other Users, our affiliates, our Partners, third parties, and service providers. This section explains when and why we share your information.
      1. User Content
        1. Your member profile and information that you post or share, such as tutor biography, educational background, city and state, photos, reviews, comments, suggestions, and information about you or your experience, may be seen and shared with other Users of our Service. If you do not want it listed publicly then either do not share it with us when listing your biography or notify us to remove it.
      2. Information Shared Between Users
        1. The Tutoring Institute shares a minimum amount of personal information between tutors and students/parents/guardians in order to facilitate the arrangement of tutoring sessions, including, your first name and last initial (student’s name if contract is with a parent), city, photo, and details about the tutoring services you seek or provide. Messages to students also, contain tutors’ full name.
  5. Cookies and Similar Technologies

    1. Third parties, including Facebook, may use cookies, web beacons, and other storage technologies to collect or receive information from our Platform, apps and elsewhere on the internet and use that information to provide measurement services and target ads. Most web browsers let you choose whether to accept cookies and let you delete cookies already set. The choices available, and the mechanism used, will vary from browser to browser, but are typically found in the “options”, “tools” or “preferences” menu. There also are online tools available for clearing all cookies left behind by the websites you have visited, such as www.privacypolicies.com.
    2. Service Providers
      1. We engage service providers to perform functions and provide services to us in the United States. For example, we use a variety of third-party services to help operate our services to help us understand the use of our services, such as Google Analytics. We may share your private personal data with such service providers for business purposes such as to verify transactions and prevent fraud or identity theft, subject to obligations consistent with this Privacy Policy and any other appropriate confidentiality and security measures, and on the condition that the third parties use your private personal data only on our behalf and pursuant to our instructions (service providers may use other non-personal data for their own benefit). We may share your payment information with payment services providers to process payments; prevent, detect, and investigate fraud or other prohibited activities; facilitate dispute resolution such as chargebacks or refunds; and for other purposes associated with the acceptance of credit and debit cards.
      2. If you utilize our YouTube channel, you are subject to the Google Privacy Policy, located at policies.google.com/privacy.
  6. Affiliates and Change of Ownership
    1. If we are ever involved in a bankruptcy, merger, acquisition, reorganization, or sale of assets, your personal data may be sold or transferred as part of that transaction. This Privacy Policy will apply to your personal data as transferred to the new entity.
  7. Law and Public Interest
    1. Notwithstanding anything to the contrary in this Privacy Policy or controls we may otherwise offer to you, we may preserve, use, or disclose your personal data or other safety data if we believe that it is reasonably necessary to comply with a law, regulation, legal process, or governmental request; to protect the safety of any person; to protect the safety or integrity of our platform, including to help prevent spam, abuse, or malicious actors on our services, or to explain why we removed certain accounts from our Services; to address fraud, security, or technical issues; or to protect our rights or property or the rights or property of those who use our Services. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your personal data.
  8. Data Transmission And Storage
    1. The Tutoring Institute uses industry-standard 128-bit SSL encryption when collecting and transmitting your information through the Platform and the The Tutoring Institute network. Once information has been collected, we encrypt sensitive data in our database for added security. The Tutoring Institute also uses firewalls and hardware monitoring across our system to protect against unauthorized access. Unfortunately, even with these measures, The Tutoring Institute cannot guarantee the security of personal information. By using the Service, you acknowledge and agree that The Tutoring Institute makes no such guarantee, and that you use the Service at your own risk.
  9. Managing Your Personal Information With Us
    1. Modifying or correcting your information
      1. If you have an account with us, you can access, correct, delete, or modify some of the personal information you provided to us in your account settings or email us at help@thetutoringinstitute.com.
    2. Email
      1. The Tutoring Institute may send you email communications periodically detailing new Service features or promotions. You may unsubscribe from these messages by using the link at the bottom of the email or emailing us at help@thetutoringinstitute.com. You will still receive email messages about your account, or any notices as required by law. You may not opt-out of receiving these administrative emails so long as you continue to use the Service. If you wish to terminate your account, please contact us via email at help@thetutoringinstitute.com.
    3. Location Information
      1. You can prevent your device from sharing location information through your device’s system settings. However, by doing so, this may impact The Tutoring Institute ability to provide you our full range of features and services.
    4. Cookie Tracking
      1. You can modify your cookie settings on your browser settings. If you delete or choose not to accept our cookies, you may be missing out on certain features of the Service.
    5. Do Not Track
      1. Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services that you do not want them to track your online activities. The Service does not currently support Do Not Track requests at this time.
  10. California Residents
    1. The California Consumer Privacy Act (CCPA) provides some California residents with the additional rights listed below.
    2. Right to Know
      1. You have the right to know and see what data we have collected about you over the past 12 months, including:
        1. The categories of personal information we have collected about you;
        2. The categories of sources from which the personal information is collected;
        3. The business or commercial purpose for collecting your personal information;
        4. The categories of third parties with whom we have shared your personal information
        5. The specific pieces of personal information we have collected about you.
    3. Right to Delete
      1. You have the right to request that we delete the personal information we have collected from you (and direct our service providers to do the same). Note that deletion requests are subject to certain limitations, for example, we may keep information as required or permitted by law, to process transactions, certain account-related information, to facilitate User requests, and protect and fix our system.
    4. Other Rights
      1. You have the right not to be discriminated against for exercising any of the rights listed above.
    5. Exercising Your California Privacy Rights
      1. To request access to or deletion of your personal information, or to exercise any other data rights under California law, please write us at help@thetutoringinstitute.com.  Please include your full name, email address, and phone number associated with your account on the Platform, along with why you are writing, so that we can process your request in a proper manner.
    6. Response Timing
      1. We try to respond to a consumer request for access or deletion within 30 days of receiving that request. If we are unable to accomplish that request in 30 days, we will email you to explain the reason and an extension period.  If we do not have your email, then we will respond in the manner that you contacted us.
  11. Children and Our Services
    1. This Service is not intended for use by children under 13 years of age.
    2. The Tutoring Institute does not knowingly collect personally identifiable information from children under the age of 13. If you are under the age of 13, please do not provide your contact information or any other personally identifiable information to The Tutoring Institute. If you are the parent or legal guardian of someone under the age of 13 who may have provided us with information without your knowledge or consent, please contact us to have this information removed. All contact, including tutoring sessions, between a tutor and any minor should take place only in a supervised setting.
    3. Messages sent between the tutor and student or parent through the platform will be visible to the administration and might be saved indefinitely. All messages between the tutor and student will also be visible to the parent if the student is under the age of 18. Messages will not be allowed between the tutor and students under the age of 13.
  12. Privacy Policy Changes
    1. The Tutoring Institute reserves the right to change or update this Privacy Policy from time to time. Changes to the Privacy Policy will be updated here. You should review the Privacy Policy for changes and updates.
    2. The Platform is hosted in the United States and is governed by United States law. If you are using the Platform from outside the United States, please be aware that your information may be transferred to, stored and processed in the United States where our servers are located, and our databases are operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By using the Platform, you consent to your information being transferred to our facilities and to the facilities of those third parties with whom we share it as described in our Privacy Policy.
